Landlord - Tenant Information
Responsibilities of Landlords and Tenants
Section 7.13 of the CC&Rs specifies the conditions for renting or leasing an Owner's dwelling unit or part thereof:
- Written rental agreements are required.
- The period of the rental or lease is not less than thirty (30) days.
- Tenants or leasees are subject to all provisions of this Declaration, the Bylaws and the Association rules and regulations
- Tenants or leasees failure to comply with any provision of this Declaration, the Bylaws and the Association rules and regulations shall constitute a default under the rental or lease agreement.
- Tenant or leasee must be given a copy of this Declaration, the Bylaws and the Association rules and regulatios.
- The Owner shall be liable for the tenant's failure to comply with this Declaration or Association rules and regulations to the same extent as the tenant
Section 11.9 of the CC&Rs specifies that the Owner shall be responsible for obtaining compliance and is liable for any failure of compliance to the same extent as if the failure had been committed by the Owner.

Suggested rental or lease agreement addendum
Below is an example of a portion of an "addendum" one Owner has added to the written rental agreement they use with their tenants. Note that a space is provided for the tenant to initial that they have read and understand the requirement. Also note that the addendum satisfies the requirement to provide copies of the Declaration, Bylaws and Association rules and regulations through providing a link to the Association web site.
_____ (for tenant to initial) Tenant agrees that failure to comply with any of the provisions of the Declaration, Bylaws and Association rules and regulations (governing documents) shall constitute a default under the lease agreement; including but not limited to: keeping all trash and recycling containers out of sight between trash/recycling pick up days, or engaging in noxious, harmful or offensive activities that is a source of annoyance to other occupants.

Enforcement
The Board is empowered under section 8.2.1 Enforcement to enforce any or all violations to the CC&Rs against the Owner. The method of enforcement is stipulated through the Financial Penalties Resolution.
Enforcement can take the form of monetary fines and can be secured through liens placed on the Owner's real property at Meadows at Timberhill.
